Terms and Conditions — Consulting and Intermediation of Specialized Maritime Services
1. Nature of the Service and Intermediary Status
1.1. Intermediary Capacity. The Website and the services offered by the Company constitute a consulting and intermediation platform intended to connect users, clients, shipowners, shipping companies and maritime service providers. The Company acts solely and exclusively as a commercial intermediary, with the exception of maritime consulting services and inspection and audit services.
1.2. No Carriage or Shipowning Relationship. The Company is not and does not operate as a shipowner, charterer, direct shipping agent, or final provider of the requested transport or logistics services. The final contracting of any maritime service will be formalized through direct and independent contracts between the corresponding parties.
2. Disclaimer and Limitation of Warranties
2.1. Informational Nature of Rates and Availability. All information, technical vessel specifications, estimated rates, route availability or cargo capacity shown on this Website or transmitted through contact forms is for informational and guidance purposes only. Such data does not constitute a firm, binding offer or a guarantee of availability.
2.2. Limitation of Operational Liability. The Company is not responsible for contractual breaches, delays, cargo damage, operational interruptions, maritime casualties or economic losses arising from agreements formalized directly between users and third-party maritime service providers.
3. Applicable Law and Jurisdiction
3.1. Applicable Legislation. These Terms and Conditions, as well as the use of this Website and the commercial relationships resulting from general intermediation, shall be governed by and interpreted strictly in accordance with the laws of the Republic of Panama.
3.2. Competent Jurisdiction. For the resolution of any dispute, litigation or claim arising from or related to these Terms and Conditions or the use of the Website, the parties submit to the exclusive jurisdiction of the Ordinary Courts of Panama City, Republic of Panama, expressly waiving any other venue or jurisdiction that may correspond to them by reason of their present or future domiciles.
4. Additional Privacy Policy Clause “Corporate and B2B Data”
We collect corporate and contact information (representatives’ names, corporate emails and telephone numbers) for the sole purpose of facilitating maritime intermediation and consulting activities. In accordance with Law 81 of 2019 of Panama on Personal Data Protection, your data will not be sold or transferred to third parties outside the commercial relationship without your prior consent.
Service Warranty
We offer a quality guarantee on all our consulting services. This means that:
- We commit to delivering reports, plans, strategies and materials on time and as agreed in the contract.
- We guarantee that all work is carried out with professional methodologies based on sound business practices.
- If errors are detected in the deliverables (incomplete information, poorly framed financial calculations or inconsistent formats), we commit to correcting them at no additional cost.
- We do not guarantee specific results (such as sales, profits or immediate growth), as these depend on the correct implementation of the recommendations by the client and on factors beyond the scope of our consulting.
Satisfaction Guarantee
- Term: We offer a satisfaction guarantee of 30 calendar days, counted from the start date of the service provided.
- Precedence of the Contract: The conditions, scope, return terms and specific warranties formalized in the individual service contract signed between the parties shall replace and supersede the general conditions of this website satisfaction guarantee.
